Intangible cultural heritage legal protection problem has become a hot topic among jurisprudential circles from home and abroad, it is both a theoretical and practical problem which needed to be solved immediately. Intangible cultural heritage contains the nation’s historical memory of life, represents the traditional history and culture of all nations in our country, it is not only the wisdom of all nations, but also the power source of existence and development of a country and nation. However, the studies of ethnic minorities’ intangible cultural heritage in our country are a few, especially the researches which aim at ethnic minorities’ non-material cultural heritage legal protection in Xinjiang are rare. Culture is not a kind of power, not the reason for causing social events, actions, systems or process; it is a kind of mainstream in which those social phenomena could be clearly descript. In the practice of culture, many ethnic minorities’ intangible cultural heritage in Xinjiang haven’t achieved a strong legal guarantee, and some intangible cultural heritage are even endangered. Therefore the legal protection is desperately in need.The thesis mainly analyzed and exposited the present situation and the existing problems of legal protection system of the ethnic minorities’ intangible cultural heritage in Xinjiang, the necessities and strategies of law protections through five parts. The first part is introduction; The second part expounds the intangible cultural heritage and the basic theory of minority intangible cultural heritage: the concept, characteristics, and classification; The third part mainly expounds the overseas practice of intangible cultural heritage legal protection for reference, analyzed five central Asian countries for reference to the practice of the protection of intangible cultural heritage. The fourth part analyzed present situation of legal protection of the ethnic minorities’ intangible cultural heritage in Xinjiang, put forward the existing problems in legal protection of the ethnic minorities’ intangible cultural heritage in Xinjiang.The fifth part is methods of legal protection of the Intangible cultural heritage of ethnic minorities in Xinjiang, the author also proposed some suggestions of legislation.
