The basic principles of economic law have different representations based ondifferent theories. When the principles put forward by different scholars add up, theyare even up to more than40. The term “social responsibility” is more as the form of“corporate social responsibility” to appear in our sights, and the current proposition of“corporate social responsibility” has been achieved broad consensus both in theoryand in practice. However, more researchers in the field of economic law holdconsistent view that the economic law is to protect the public interest, and somescholars propose the concept of social responsibility-based or community-basedprinciples of economic law. But they are too abstract or one-sided This article is basedon several aspects, such as the connotation, value, features and objects of economiclaw, to analyze and explore the reasonability and scientific of regarding the principleof social-based as the basic principle of economic law. This article contains five parts.The Introduction tells the background, meaning and value of this article. It alsotalks about the current situation of the study on the principle of social responsibility athome and abroad. In addition, the research method, the advantages and thedisadvantages of this article are introduced in this part.Chapter I and Chapter II analyzes the basic principles of economic law throughthe explanation for basic principles of law. Then this part generally analyzes thepresent basic principle of economic law, and through which probes the establishmentstandard of the basic principle of economic law in new era. Furthermore, this articlebelieves that four factors-expansibility, economy, sociality, and modernity-should beattached importance when we set the standards. It also regards the integration ofprinciple and flexibility as well as social benefit as the settlement standard of basicprinciples of economic law. At the same time, this part chooses the economic cost asthe analyzable method. According to the standard and the method as I mentioned, thisarticle deduces that principle of economic law is made of the economic fairnessprinciple, the economic efficiency and the principle of social responsibility.Chapter III firstly analyzes the word of social responsibility both fromconnotation and denotation to tell the important meaning of social responsibility toeconomic law from the external dimension. Secondly, this chapter distinguishes therelation between the principle of social responsibility and the base of socialresponsibility. Moreover, combined with different legal subjects in economic law, this chapter deduces that it is reasonability to regard the principle of social responsibilityas the basic principles through the analysis from several aspects such as the objects,range, value, and features of economic law. Finally, this chapter discusses thescientific to regard the principle of social responsibility as the basic principles ofeconomic law from the theoretical innovation, the institution design and the practiceof economic law.Chapter IV compares the social responsibility principle, the economic fairnessprinciple, the economic efficiency principle. Through the comparison, this chapterfurther discusses the meaning of regarding the principle of social responsibility as thebasic principles of economic law from the internal dimension.In the Conclusion, this article gives a brief forecast about the future of EconomicLaw in our country under the principle of social responsibility.
