On The Protection Of The Rights And Interests Of The Old People Under The Guardianship System In China

The world is stepping into the aging society in an irreversible trend, people paymore attention to the aging problem. China has entered the aged society in1999. Thehigh aging speed of China has brought widespread and profound impact to itseconomy and the welfare of its people. In the old before getting rich conditions,strengthen the protection of property rights and interests of the elderly, has becomethe first priority for China to cope with the aging society. In view of the elderly withage, memory decline, judgment, characteristics of sluggish, the protection of propertyrights of elderly people to study in the framework of monitoring system, will providea new way to solve this problem. This article is based on China’s guardianship systemreform, learn from the experience of international legislation, improve the elderly caresystem at the same time, independent of the framework of elderly people propertyprotection system. This paper focuses on the problems of the elderly guardianshipsystem to protect property under article is divided into three parts:Chapter One, Social Value and Status of The Elderly Property Protection System.This part explains the necessity of improving the old-aged guardianship system inChina from three perspectives, namely population background, foundation of thinkingand the requirements of the reality. Secondly, analysis of the existing guardianshiplegislation lags behind and limitations, shows that the discrepancy between legislationand social demands, the urgency of prominent guardianship system reform.Chapter Two, The Special Nature of The Elderly Property Protection. Differentproperty protection from the protection of the property of old people and minors,mental patients to proceed, prominent in the monitoring system, the necessity andfeasibility of separate elderly people property protection system.Chapter Three, Construction of The Elderly Property Systerm. The last part ofthis article simply introduces the plan of the elderly people property protectionsystem,such as application object, qualifications, duties to protect the elderly people,and creats a new guardianship system to strengthen the supervision of theguardianship systerm. While constructing the elderly care system, we have to buildelderly property protection system independently.
