On The Value Of Judicial Publicity

The judicial reform is the focus of our national newwork,and the judicial public is an important task of thenew judicial reform determined by the central.The courtsat various levels and the supreme court have carried on thesystematic research on the judicial public problem inaccordance with the judicial reform plan and the requestof the “3by5” reform outline of the supreme court since2008.At present,the problems about judicial public whetherin practice or in theory have been studied,and we have takencorresponding improvement strategies to promote thejudicial public system.However,through a comprehensiveanalysis of the current situation of China,it is easy tofind that there are still many problems about the justicepublic.By further analysis,we find that the root of manyproblems in practice is the short of the judicial publictheory,and we do not have unified guiding ideology aboutthe judicial public,leading to all sorts of the problemsin the judicial practice.So,at first,we should definite theguiding ideology about judicial public in order to promotethe judicial public system.And in this paper,we will tryto build the theoretical basis of judicial public based onthe existing analysis from the perspective of legalphilosophy.Firstly,we will explore the interactiverelationship between the judicial public system and our society based on the existing analysis about the judicialpublic system from the perspective of legal philosophy,andwhat the judicial public system as a tool can play in oursociety.Then,we focus on the value that the judicial publicsystem itself contains from the perspective of legalphilosophy in order to study the value of the judicialpublic system,as well as the logic relations between thesevalues.Finally,according to the actual situation of China,we will try to build the judicial public system on the basisof the comprehensive analysis.
