On Supervision Of News Public Opinion And Judicial Justice

Media supervision and judicature both play crucial roles during the process of constructionfor a country under rule by law. What they have on the values and goals in common makes themcooperate and promote mutually. The relationship is conflict in reality, between the judicialjustice and the media supervision, because of their own features. Recent years, the problem abouttheir relationship especially the conflict, is becoming the focus of the theoretical area. Therefore,it is an urgent problem for the protection of social justice to balance the relationship between thejudicial justice and the media supervision. At present, the study about this topic lies in theabstractive relationship, and ignores doing some comprehensive surveys about the presentconditions and features, lacking of the essences. Therefore we combine the basis of the formerresearch, making an essential analysis of the reasons for the conflict.This article consists of three parts: the preface, the body and the conclusion. The prefacemainly contains some research on the judicial justice and the media supervision. The mainly textis divided into four chapters. In the body, the first chapter is “the overview of the judicial justiceand the media supervision.” It introduces the chapter and features of the media supervision, andit comes to a conclusion of its necessity. Meanwhile, it defines the two protection of the judicialjustice. On the basis of the features of the two above, we get the virtuous relationship betweenthem, that is, the media supervision promote the judicial justice and the judicial justice protectthe media supervision. The second chapter is “the conflict between the judicial justice and themedia supervision.” Firstly, we make an analysis of the present conditions for their conflict byusing some related cases and data, getting external reasons on the cases. We also come to theessential reasons from four aspects: the value, the interests, power and rights, rights and rights.The third chapter is “balancing the conflict between the judicial justice and the mediasupervision.” It concludes the necessity of this balance and what principles should be followedduring this process. The fourth chapter is the construction for this balance. Concretely speaking，it contains three parts: the media should set more rules to regulate their duty；as for thegovernment, definite laws must be established at once; what is more, the judicial departmentshould have an active action to strengthen their dependence.
