Research On The Relationship Between Media Supervision And Judicial Justice In China

With the development of the society,the reform of the judicial system and the promotion of the democratic consciousness of the public,the media are more and more active in supervising the judicial practice in our country.Especially with the increasing variety of media forms and media platforms,media can bring all kinds of fresh hot events to the public,just as a necessity of social public life.The timeliness and extensiveness of the dissemination of media information enable the media to fully play its role in monitoring judicial activities,it is of great significance to protect the legal rights of the parties,realize judicial justice and promote the construction of democracy and rule of law in China.However,in essence,media supervision is a double-edged sword.In the process of media supervision of judicial activities,if we do not pay attention to the assurance of "degree",it may cause the media's improper supervision to be superior to the judicature,then it may interfere with the normal judicial activities,which is not conducive to the realization of judicial justice.So,in the process of media supervision of judicial justice,how to grasp the "degree" of media supervision of judicial activities and seek a balance point between them,thus forming a harmonious relationship between media supervision and judicial justice,this is a problem worth studying and solving.Starting from the basic theories of media supervision and judicial justice,on the basis of defining the meaning of the two,this paper analyzes the main body and means of media supervision,and the new features of media supervision caused by the progress of new technologies such as network technology and artificial intelligence.Secondly,starting with the status of the relationship between media supervision and judicial justice in China,this paper analyzes the conflicts between them,such as the conflict between moral judgment and legal judgment,the conflict between timeliness and lag,the restriction of media freedom by judicial independence,etc.,the aggravation of the conflict not only damages the judicial independence and authority,but also limits the development of the media supervision itself.At the same time,the concrete and substantial causes of the conflict are analyzed.Thirdly,it discusses the practical experience of coordinating the relationship between media supervision and JudicialJustice,and discusses the enlightenment of the experience of foreign countries on coordinating the relationship between media supervision and judicial justice.Finally,according to the actual situation of our country,this paper puts forward some effective measures to solve the conflict between media supervision and judicial justice,and realize the harmonious development of the two,improve the media supervision mechanism to improve the professional quality of media workers and the self-discipline of the media industry,by improving the judicial information disclosure system,strengthening the self-discipline of judicial personnel and perfecting the press spokesman system,the judicial management system can resolve the conflict between media supervision and judicial justice,and promote the harmonious development of the relationship between the two.
