Study On Administrative Coercive Measures In Food Safety Supervision

Right of using administrative enforcement measures is an important executive power conferred by law. Compulsory administrative measures are means of supervision commonly used in administrative supervision practice. The promulgation of Administrative Compulsory Enforcement Law further standardizes the public authority and safeguards the rights and interests for administrative counterparts. The frequently happened food safety issues brought unprecedented test for the administrative efficiency of the regulatory authorities. In the current situation, how good the compulsory administrative measures are applied in the field of food safety supervision is of great theoretical and practical significance.In this paper, the origin and manifestations of the compulsory administrative measures in the field of food safety supervision as well as the current status of application and the problems in the practice of food safety supervision using administrative enforcement measures are elaborated. The improvement in view of the problems are given to administrative enforcement measures in the field of China’s food safety supervision.
