Research On Urban Community Governance Mechanism Based On Soft Law

The modernization of the urban communities’ governance is the important component and the basic support to promote the modernization of the national governance’s system and the governance’s ability.However, the optimization and perfection of the mechanism about the urban communities’ governance is the core content of the modernization of the urban communities’ governance.The formation and operation of the mechanism depends on rules,rules in the reality of the urban communities’ governance include the system of the hard law that promotes and protects the basic civil rights and obligation,achieves and maintains the political order and the economic order and makes the social orders ordering;there are also the regulatory system of the soft law that have the nature on the pledge, calling, non obligation, autonomy to response actively and flexibly to the complex reality, diversified demands, cooperative action and autonomous desire.The practice based on the soft law of the mechanism of the urban communities’ governance in Chongqing has already beginning to explore and obtain some basic experiences.Therefore,this paper has the important theoretical value and practical significance that it is as the starting point to explore the suggestions based on the soft law for improving the mechanism of the urban communities’ governance.The first part of the full text mainly introduces the research’s background, the research’s methods, the research’s meanings,and does the simple carding towards the relevant research literature.The second part mainly explains the practice’s characterization and theory’s implications about the basic concepts like the connotation of soft law, the governance,the mechanism of communities’ governance,and preliminary to clarify the relationship between soft law and the mechanism of the urban communities’ governance,and by the analysis’ perspective of the doctrine of the "structure-function" clearing up the basic status and the function of identifying and restrictting.The third part analyzes the basic experience and the existing problems of the construction based on the soft law of the mechanism of urban communities’ governance,through the real case about the construction of the mechanism of urban communities’ governance in Chongqing.The fourth part that obtains the recommendations based on complying the first three parts to perfect the mechanism of the urban communities’ governance:first to understanding and grasp the embedded of the soft law to the structure of the urban communities’ governance—— the flexible and the mutability of the soft law in coordination with the dynamic and the complex of the urban communities’ governance,the soft law’s function of the integration corresponding to the multifaceted cooperation of the urban communities’ governance,the identification of the restriction works in with the interactive negotiation of the urban communities’ governance;Secondly emphatically strengthening the construction of the five mechanisms based on the practical features and the constrained condition about implementing function of the soft law:the mechanism of supplying rules,the mechanism of communicating information,the mechanism of the main bodies working in coordination with each other, the mechanism of the consultative dialogue,the mechanism of the implement security.
