A Study On The Perfection Of Administrative Legal Supervision System In China

With the continuous implementation of the rule by law, the requirements of law-based administration have also been improved. Fully depending on the mechanism of the administrative supervision of legal system is needed in order to achieve the overall law-based administration. It can effectively supervise and restrict the administrative power.60years since the founding of The People’s Republic of China, along with the continuous exploration and reform, the system of administrative supervision of legal system in our country has been preliminarily formed. China has promulgated and implemented series of relevant administrative supervisions of legal system, oagainst corruption laws and regulations. Our country has already formed the administrative legal supervision system. The system includes both internal and external supervision. Administrative power is charactered by expansion,compulsion and universality. In our country, administrative power has been involved in every aspect of social life, even from the administrative area extended to the legislative fields and judicial fields. The correct exercise of administrative power can promote the safeguard of both social stability and the rights of citizens. However, inappropriate exercise of the administrative power could seriously threaten civil rights and social order. Due to a long-term impact of China’s fedual autocracy and the nature of selfishness, the administrative subject will pursue the maximization of benefits,which leads to the existence of a large number of corruption, the abuse of power and the administrative omission. Although the supervisory system of administrative law has been improved, it still cannot fit the needs of the rule by law and the law-based administration. Because of the existence of a large number of administrative violations of law, we need to perfect the system of administrative supervision of legal system. As our country is in the key period of the economic development and the deepening of reform, studying on improving the system of administrative supervision of legal system is an important research content in administrative law. And also studying on improving the administrative legal supervision system has important significance for China’s political system reform and the reform of administrative system.This paper is divided into five chapters. The first chapter is the introduction, which mainly describes the background and significance, domestic and foreign research situation, primary research content, research methods and expected results. This chapter is to pave the way for the following research. The second chapter is the summary of administrative legal supervision. This chapter introduces the concept, classification and features of administrative supervision of legal system, and also introduces the analysis of the necessity of administrative legal supervision from both aspects of legal theory and function.The third chapter is the analysis of the present situation of administrative supervision of legal system in China. This chapter summarizes the important current provisions of the administrative legal supervision system of our country, and analyzes the existing problems in the administrative legal supervision system. This chapter is the basis of reform and perfection of the system of administrative legal supervision. The fourth chapter is the provisions on administrative supervision of legal system in foreign countries and their inspirations. This chapter analyzes the mature"Administrative supervision of legal system" in some foreign countries. Combining with the actual situation in China, some inspirations and further improvements on administrative supervision of legal system can be drawn from the supervision mechanism. The fifth chapter is about how to perfect the system of administrative supervision of legal system in China. Series of proposals have been put forward according to the existing supervision in our country administrative legal system problems. Hoping that the administrative legal supervision system can adapt to the needs of "the rule by law" and "the law-based administration", and also it can promote the healthy development of China’s social order and economy.
