Housing has been an important livelihood issue concerned by people andgovernment. With the rapid development of China’s economy and society, especiallythe crazy growth of housing rates in recent years, sky-high price houses emerged fromplace to place, but most of people families who are in low and middle-income can notafford the prices of market regulation mechanism, and there has been a growing “ant”,“dwelling”, and “house slaves”, which is a true reflection of the grim realities ofChina’s residential housing conditions. As an important topic of Chinese housingsecurity system, the construction of public rental housing system is also significantmeasure of the realization of housing rights of citizens, and the country are activelyexploring for local environmental management system aiming at promoting economicdevelopment and maintaining social stability. However, during the progressivedevelopment of public rental housing system, various problems and shortcomings alsohave been revealed, and how to ensure that citizens enjoy the residential rights,provide better housing security, and effectively solve the housing difficulties oflow-incomers’ has become an important part of the government’s public policy.In this paper, the concept of public rental housing will be firstly definedtheoretically, and the content and features of it will be further cleared and compared.In reviewing the history of the development of public rental housing, while it furtherdetail the implementation of practical significance and social value of public rentalhousing system. Then the legal theoretical foundation and significant value of publicrental housing institution building will be elaborated from a theoretical perspective ofthe Legal Philosophy, Constitutional Law, Administrative Law, Social Law, andEconomic Law.In practice, related issues will be summarized by evaluating and analyzing thecurrent situation of the country’s implementation of the construction of public rentalhousing system: first, the analysis of the status of implementation of public rentalsystem at this stage, such as the construction of public rental projects, legislationsecurity and periodic results which have been achieved. Second, the existence of main problems and shortcomings of public rental system in legislation, practice andtheoretical study will be pointed out, including issues in regulations and policies,institutional design and specific implementation, and in-depth analysis of the causeswill be done.Finally, the successful experience of developed countries and regions to buildand improve China’s public rental housing system will be used for reference bysummarizing its practice of legislation. On this basis, from perspective of Chinesebasic principles and overall goal design of public rental housing system construction,suggestions and project will be put forward to improve the program and theconstruction of public rental system.
