In this paper, comparative law, case analysis, document analysis and inductive method to study the legal system of public rental housing, the meaning of the basic features and basic elements. Respectively, from the constitutional law, economic law point of view in-depth analysis of public rental housing, the legal basis for the legal system; from the theory of public goods, housing support theory, theory of distributive justice, housing filtration theory, market failure and government failure theory expound the law of public rental housing system theory. Systematic analysis of the legal system of public rental housing, real estate market in effective interventions to improve housing security system, housing, public resources to achieve sustainable development, improve the rental housing system and other aspects of practical significance and role. Through our existing public rental housing, an overview of the legal system, the basic content, and outside the public rental housing system analysis and summary, combined with the domestic legal system of public rental housing throughout the operation, a comprehensive analysis of China's current legal system and its public rental housing defects. Finally, the principle of legislation, a clear legislative basis in the Constitution, to develop higher-level laws, improve the supporting systems such as the angle of how to improve the legal system of public rental housing. At the same time, respectively, from the legal nature of planning, housing and improve public rental housing system, management system, access to exit mechanism, monitoring audit mechanism in terms of accountability mechanisms to ensure that public rental housing, the effective operation of the legal system put forward countermeasures and suggestions.
