In terms of China,it is committed to creating an inclusive benefit sharing mechanism according to the nature of the socialist country and the background of the transitional society.Under this situation,the country is usually subject to more active obligations.Out of the basic goal of providing the guarantee for people's livelihood security and social stability,many cities in our country have carried out a certain scale of public rental housing construction since 2009.By starting from the perspective of constitutional law,as an important institutional guarantee for the realization of civil social rights,the public rental housing system's construction and practice should be based on the theory of state protection obligations.Under the guidance of the state within the framework of the rule of law,it hopes to achieve the important social goal of "home ownership".While the public rental housing system from the perspective of national housing security obligations in China refers to the system that the state as the main body of housing security should fulfill the positive housing security obligations,so as to meet the minimum housing requirements of the poor groups in the society in terms of housing.Nowadays,our country's legislative status of the public rental housing system is reflected in the absence of laws at the central and local levels,as well as the lack of enthusiasm of local legislation.According to the empirical research of Beijing,Shanghai,Chongqing,Shenzhen,Hangzhou,Zhengzhou and so on,it is found that the practical difficulties of the public rental housing system in our country are mainly manifested ininadequate public participation in prior decision-making,imperfect access conditions and management mechanism during the event,and imperfect exit and supervision mechanism after the event.When it comes to the main cause of the above practical difficulties,it mainly reflects in the absence of pre-event procedures because of the lack of legislation,the rigidity of access and management mechanism because of the low efficiency of law enforcement,and the imperfection of exit and post event relief mechanism because of the lack of supervision.Based on this,it is necessary to establish relevant laws and regulations of public rental housing,improve the decision-making procedure of public rental housing in advance,standardize the access and management mechanism of public rental housing,and perfect the withdrawal and supervision mechanism of public rental housing,so as to solve the practical dilemma of the public rental housing system in China.
