Housing problems are bound to exist in any country and any era. As proposed byEngels in his “On the housing problem”,“the lack of Residential phenomenon” is theproduct of industrial development and urban development. In modern society, the rapiddevelopment of industrialization, the urban concentration of population, the resultinghousing shortage predicament has become an inevitable trend.“Food is aground-living”. Housing as living the basic consumer information is one of the basicelements of human survival and development. How to solve “everyone has adequateshelter for all” instead of “Home Ownership Housing” is the core concept of thehousing reform.The early1990s, China began to implement the structural reform of the housingmarket. The core of reform also stressed the importance of the establishment of ahousing guaranty system. In the housing guaranty system, the affordable housing andlow-rent housing, as two kinds of housing pattern, has mentioned frequently in solvinghousing problem. But in reality there is a standard “sandwich class”(they can’t affordaffordable housing, or apply for the low-rent housing). How to the governmenteffectively solve the housing difficulties of the “sandwich class” has stand out.Concerning about this part of the housing security issues, the Ministry of Housing andUrban-Rural Development in2009renewed the direction of development of affordablehousing. Public rental housing, affordable housing and low-rent housing will be formedto a system. Furthermore,“Suggestions about accelerating the development of publicrental housing was published on the87thdocuments by in2010security development of“Guidance on accelerating the development of public rental housing”.This paper focuses on the legal system of our public rental housing through fouraspects, taking the system of Chongqing’ public rental housing system forexample.First of all, I introduce the background of public rental housing. It is theeffective way to solve the problem of the “sandwich layer”. Secondly I explain thestatus of China’s public rental housing system, focusing on Chongqing’s public housingsystem. Third through the introduction of overseas public rental housing system, we canlearn from their experience, after comparing the current situation with the nationaldifferent conditions of those countries and areas; Finally, combining Chongqing on themerits of the development of public rental housing, the author lend some suggestions to improve our public rental housing system.
