Research On Incompleteness Of Property Right System Of Rural Land In Our Country And Its Improvement

Property right system of agricultural land is a very important part of national property right system of land, it is also the essence and key point of rural system in our country. Currently, Property right of agricultural land describes as a simple system that peasants only own the contract and operation right to the rural land under a vague property right of collective land of peasants. This article tries to research, analyze and diagnose on the definition of property right of land, ownership, and its effective protection from the view of economy and law, and to probe the cause of shortcoming of system designing, limitation factors of system transition, and the endeavor direction of system improvement, then it is concluded that the property right of collective land of peasants should be weakened and peasants should enjoy the operation right of agricultural land of "privatization". Finally constructive suggestions are presented in terms of reform and improvement of property right of agricultural land. And the property system of agricultural land such as right system, function and protection is carefully designed, while the related systems are also proposed to reform.
