After acceding to WTO, China is faced with a series of transforming mould and repositioning problems on system selection and the policy arrangement. In this process, striving for the reasonable settlement of "three farming" problem and safeguarding peasantry's rights and interests earnestly benefit for drawing internal demand effectively and guaranteeing that economy development is healthy, steady,harmonious in China.More recently, with the rapid expansion of China's industrialization and urbanization, a great quantity of the collective-owned land convert the state-owned constructing land by way of expropriation. Although, the original intention of the non-farming system of land currently in effect is designed in order to dominate urban construction invading and occupying collective-owned land (cultivated land) rigorously, control the non- farming progress of land, guarantee cultivated land security. Yet, the original intention of the system design is disobeyed in reality, not only on the contrary but also aggravating the non- fanning progress of land. Moreover it gives rise to grave benefit conflict among peasantry, collective and government, which threatens importantly to market sequence, steady development of economy and community. Seeing that the non-farming system of land shall have been common problem relate to wide-range after a considerably long period. This essay emphasize on analyzing and summing up the defect of land expropriation system currently in effect at the system bed plane, and exploit the correlation theory property right economics to dissect the deep economic cause of problem. On this base, putting forward advice about the peasantry land property right limit and striving for the newly framework of the non-farming system of land in order to guarantee peasantry land rights and interests and Pareto improvement of the systems in itself in taking the land opening up as the economy development of forerunner.
