China became a regular member of the World Trade Organization (WTO) at the end of 2001. So far, however, such countries as the USA, the EU and Japan have not yet officially accept China as a country of market economy. A series of discriminatory provisions on antidumping to China arising thereof produces extremely adverse impact on development of Chinese foreign trade. So, the market economic position has already become the largest barrier restricting response of Chinese enterprises to antidumping lawsuit .Chapter One of this thesis mainly expounds and studies the definition of"Non-Market Economy Country"in the antidumping laws of WTO, the United States, and European Countries. It analyzes impact of definition of"Non-Market Economy"on Chinese enterprise in response to antidumping lawsuit. The reason why the Western countries define China as the non-market economy country is that China is a country led mainly by public ownership and planned economy, and further, the state monopolizes the most portions of trade. So far as many as 42 countries have already acknowledged the market economy position of China, among which, however, only the Republic of Korea has exceeded trade volume of 100.00 billion USD. The United States, the EU and Japan have not yet acknowledged the market economy position of China.Chapter Two of this thesis demonstrates and analyzes main difficulties and problems for Chinese enterprises to make response to foreign antidumping lawsuits. The first problem involves ownership of enterprises, and control structure of the company. During the process when Chinese enterprises propel restructuring of state-owned enterprises, the following phenomena really exist: non-standardized control structure of some companies, governmental interference with appointment of senior management of the companies, and incomplete transformation of stock system, etc. Legal status of collective enterprises, and ownership of equity are also the pressing issued to be solved. Moreover, private enterprises are found such problems of untrue capital contribution, imperfect system of board meetings of the company and unreasonable decision making mechanism, etc. The second problem involves the accounting system and regulations of enterprise. Accounting statements submitted by Chinese enterprises are not complete, not audited or not audited...
