In the field of electronic products, all kinds of product development is rapid growing in recent ten years. In our daily life, many electronic products continue to accelerate the upgrading of development, we benefit from the Social Sciences, life become more and more convenient. But in these constantly development, the new electronic products brought "trouble" in another angle. The number of the electronic products is in an updating speed which caused more waste products, and most of waste are difficult to recycle and reused. The existence of these problems, the new technology products brought environmental, ecological and other pollution problems which cannot be ignored to the environment, The more severe situation constantly remind us to speed up the economic development mode changing, to promote clean production concept, scientific planning and industrial layout, strengthen environmental protection, take the circular economy and the road of sustainable development. Our current electronic technology products waste recycling system is not mature, it is still in the initial stage of exploration that is not perfect in recycling process and industrial pattern formation. So every year we put out a large number of wasted computer, mobile phone and other electronic products, causing serious environmental pollution problems; In addition, electronic products is the remarkable feature containing a lot of harmful substances, if this is not recognized and treated, this will produce a great threat to our health. The current China’s electronic waste legislation is in a more "primitive" state, Though we have entered into a number of laws and regulations, but most of them is not systematic and professional, some of the content is too general and vague, and even there is the existence of contradictions We need to further improve the legislation, and gradually formed an independent department law of mutual coordination, professional.In this paper, we use four parts to explore how to improve the allocation of responsibilities of related subjects in the legislation about electronic waste. The first part of the article is about how the status quo of recycling and disposal of electronic waste and the existing problems in the current stage. And we talk about the characteristics of electronic waste recycling processing and its necessity. The second part is mainly from the legislative perspective to point out our country electronic wastes in the legislative situation and existing prominent problems. The third part introduces the system of extended producer responsibility, especially in some countries, the legislation and system construction in the use of extended producer responsibility system, which provide the corresponding reference to the field of recycling of electronic waste in China. The fourth part is based on our current situation as the foundation, proposed how to allocate the liability subject in the field of electronic waste in the legislative level. In addition, we will propose some specific suggestions to build a better electronic waste recycling process in order to construct sustainable development and adaptation of electronic waste, we can provide a good foundation for the construction of a resource-saving, environment-friendly society, provide the reference for the legislation of Electronic Wastes Management in China, and provide a theoretical basis for the sustainable economic and build a beautiful China.
