The Study On China's EPR System Of Electronic Waste

Traditionally, for producers, they only need to bear the liability of environmental pollution in the process of product manufacturing. However, with more and more serious environmental problems of disposed products, practices call for producers to take more responsibility in waste, thus extended producer responsibility system appears. EPR system requires producers taking responsibility for the environmental pollution of the whole life cycle of product. For the waste product problems, the most serious polluted problems is concentrating on the field of electronic waste, so at present, the main implement field of producer responsibility extending system is electronic waste. EPR of electronic waste need producers to take all or parts of the responsibility for production of the entire life cycle of electronic products.The legislation of EPR of electronic waste in our country can be divided into two stages:one is the initial stage of development from 1989 to 2004, the other is gradual perfection stage after 2006. The legal nature of electronic waste determines the national regulation way of electronic waste, also it has important effects on extending responsibility scope that producers should fulfill. Therefore, the analysis of electronic waste producers extending obligations should be first based on the status of electronic waste in the solid waste in our country. By the analysis, however, the legal nature of electronic waste has a certain ambiguity. From extending obligation, our law stipulates mandatory obligation and advocacy obligation for electronics producers, and has set up a corresponding security system and incentive system, but there are some problems such as being lack of supporting system and poor operability. From the methods of bearing liability of extending obligation, it needs to experience the stage from the early stages of behavior responsibility to bear the cost of only pay the responsibility. The methods of commitment of our electronics producers directly jump to the advanced stage, but practice has proved that this leaping development is not reasonable. Therefore, the perfection of EPR system, the first is to differentiate the boundary of the methods of bearing liability of producers extending obligations of electronic waste clearly, the second is to perfect the legal content of mandatory extension obligations and advocacy extensions obligations, the third is to improve the concrete supporting system of compulsory, the fourth is to foster the third market of the way to undertake obligation.
