Research On Noise Pollution Prevention And Control Of Our Government Responsibility

With the rapid development of modern civilization, modern noise pollution can be seeneverywhere, to our life, study, work, rest and had serious effects, noise pollution hasbecome and air pollution, water pollution are another big pollution, noise pollution isdifferent from water pollution and air pollution as significant, therefore, the degree ofconcern far better than other risk, however, noise nuisance complaints events hasaccounted for about50%of the pollution of the environment disturbing events, noisepollution caused by environmental disputes has risen for the environment pollution,noise pollution at the top, like flu, though it is small, but long-term development is veryterrible, like warm boiled frog, harm of noise to man is not only the physical damage,but also spiritual influence character by environment damage, long-term accumulationof great harm.This paper is to explore the problem of noise pollution prevention and control ofthe government responsibility. Main prevention and control of noise pollution in ourcountry legislation was passed in1989, the environmental protection law of the People’sRepublic of China, but the relevant laws and regulations too principle, it is difficult toimplement, punishment too light, did not have the purpose of punishment of warning.Not the executive enforcement of local government, the relevant environmentalprotection department, some local governments in order to protect local interests, turneda deaf ear to the polluting enterprises, noise pollution control laws and regulations ofproblems in the aspect of government responsibility. The government law enforcementauthority and responsibility is not clear, the responsibility mutual shuffle, lawenforcement main body not enough transparency, victims often shrugged off theresidents, can only submit to humiliation, can’t do anything about it. This paperpresented the government responsibility in the prevention and control of noise pollution,and draw lessons from foreign experience, from the legislative, law enforcement level,discusses how to perfect the government’s responsibility in the aspect of control noisepollution. Improve the urban and rural planning for noise pollution prevention andcontrol of the government responsibility legislation, perfect the construction projects inthe planning permission for noise pollution prevention and control of the governmentresponsibility, improve the clear division of noise control law enforcement managementresponsibility, improve the noise control at the accountability system, improve thesystem of noise pollution control three at the same time, strengthen the law enforcementnoise pollution governance responsibilities legal consciousness, to prevent the abuse oflocal protectionism for economic benefits, at the same time learn from foreignlegislation and foreign governments to noise pollution control noise pollution controlthe advantage of duty, to control noise pollution in our country the governmentresponsibility put forward a series of Suggestions for improvement.
