Research On The Legal System Of Public Participation In Environmental Protection

With the rapid development of economy in our country in recent years, the achievement has attracted worldwide attention. Meanwhile, environmental pollution, eco-environmental deterioration, environmental resource shortage and other environmental problems are becoming attracted great attention of countries and peoples increasingly. The report of Chinese eighteenth Communist Party Congress point out:"We must raise our ecological awareness of the need to respect, accommodate to and protect nature. We must give high priority to making ecological progress and incorporate it into all aspects and the whole process of advancing economic, political, cultural, and social progress, work hard to build a beautiful country, and achieve lasting and sustainable development of the Chinese nation"The environmental problems occurred frequently for many reasons. But one of deep reasons is that Chinese people did not take much participation in environmental protection activities. Environmental protection is not only need the leading and coordination of the government, but also cannot do without the participation of the public, so it needs a mature and perfect legal system to protect the public participation. The public participation in environmental protection in China started in the1990s, after20years of development, has obtained certain result. Many environmental problems are solved by the efforts of public participation, but compared with developed countries; the development is still very backward. In our country, Current situation of environmental protection is that the public participation in environmental protection is not high, which rely solely on the government’s administrative power, resulting in a large number of environmental problems can’t be settled reasonably and properly for a long time. The fundamental cause of the current situation is mainly caused by the relevant provisions on public participation in China’s environmental protection legal system is still not perfect, whether it is clear in the citizen’s environmental right, or to broaden public participation in legal channels and so on are still exists many problems, public participation and environmental protection also do not come out to play its strength.Environmental protection is required for all countries and regions in the world people to work together to achieve the great cause. On the road of promoting environmental protection, the public is an indispensable force, and in order to ensure the public participation, legal system is the security means, so how to strengthen and improve the legal system of public participation in environmental protection is worth considering. Only by establishing a perfect legal system and providing legal guarantee for public participation in environmental protection can really play an important role in environmental protection for public. This paper firstly analyses the public participation theory, put forward the basic concept of public participation in environmental protection field, and its value is analyzed, the status quo of China’s environmental protection and public participation are analyzed and pointed out the main problems, Then introduces the advanced experience of the foreign developed countries in the public participation in environmental protection and put forward what we can learn, and finally presents some ideas about the construction of the legal system of environment protection from defining the environmental right of citizens, protecting the public right to know the environment, improving the relief system, improving the environmental field of the hearing system and encouraging non-governmental organizations to participate in environmental protection etc. The writing mainly aims to put forward some own opinions and suggestions, make own little contribution to promote public participation in the construction of environmental protection legal system.
