Study On The Improvement Of The Public Participation Of Environmental Protection System In China

Public participation in environmental protection is one of the important systems toprotect the environment resources. Public participation refers to the members of the societyconsciously voluntarily participate in social activities or the government managementaction, it is the social members active participate in various kinds of public managementdecision and the implementation of the decisions, the management of the social isdemocracy. Public participation system in environmental protection will introduce thepublic participation in environmental protection action, It is very favorable to protect theenvironment and reasonable use of the resources. At present, the system of the publicparticipation in environmental protection in China is not very perfect, there are someobstacles in the process of the system practice, don’t reach the expected purpose now. Thepurpose of this paper is to discuss how to perfect the system of public participation inenvironmental protection in our country, some concrete measures have to draw lessonsfrom some foreign advanced legal system, and combining with China’s national conditionsto improve.This paper first sets forth the overview of the public participation system inenvironmental protection, also introduced the development and the current status of thissystem, analysis and studies the significance and the important role of the publicparticipation system in environmental protection. Through compare the difference betweenChinese and the foreign legal system of the public participation in environmental protection,this chapter mainly introduces some countries how to create and use the public participationsystem in the field of environmental protection, and compares them from several angles, forexample the environmental legislation\the legal operation mechanism(in the case of how tooperate the environmental impact assessment)\the legal safeguard mechanism(in the case ofthe environmental litigation safeguard)\the environmental information disclosure system.This part also points out the characteristics of other countries in the way that the system ofpublic participation in environmental protection, and sums up the valuable experience, ourcountry should draw lessons from the experience. And then from the four dimensions:environmental legislation, environmental impact assessment, environmental litigation andenvironmental information disclosure, to analyze the main problems of public participation in environmental protection system in China. This is also the innovation of this thesiswriting methods, previous studies have similar topics, mostly the overview, or introduce acertain measures. While this article did provide, as well as the combination of total score,comprehensive system analyzes the main problems of public participation in environmentalprotection system.At the last of the paper put forward several suggestions of perfecting our country’ssystem of public participation in environmental protection, these suggestions are aimed atprotecting public participation system in China which exist the practical problemsmentioned in the previous chapter, on the basis of drawing lessons from foreign advancedexperience and the China’s current system of relevant laws and regulations for theframework. This is the key chapter of the paper, because the purpose of theory research isto improve the system, and as soon as possible to practice the perfect system, in the realityconcrete influence and contribute the environmental protection work of our country.
