Legal Research On The Environmental Protection Of Public Participation In Shaanxi Qinling Region

Protecting and preventing the destruction to natural resources, to achieve sustainable use of natural resources is the responsibility of all mankind. Qinling as an important geographical line, has a very important ecological role, the public needs to participate in environmental decision-making Qinling Mountains, Qinling Mountains to protect the ecological environment. Thus, for the current Shaanxi Qinling area Public Participation in Environmental insufficient awareness of public participation process to the legal system, the legal system is not sound public participation issues, Shaanxi Qinling region seek public participation to improve the legal system path is particularly important.In this paper, literature research method, based on existing research, legislation of Shaanxi Qinling public participation in the analysis, summed up the current public participation in environmental protection in Qinling region legal system, and field research on the Qinling Mountains in public participation system do Case study, summed up the public and especially local communities by way of the effectiveness of community participation in environmental decision-making co-management committees in the Qinling community condominium project. Then the integrated use of comparative analysis and summary analysis of the domestic and foreign more mature public participation in environmental protection of the three systems, namely, public participation in the National Park of the public system, the British system of nature reserves to participate in community condominium Jiuzhaigou Nature Reserve system to compare, analyze and summarize, identify useful reference system, including environmental information disclosure, stakeholder involvement, environmental non-governmental organizations to provide assistance, clear incentives, etc; Finally, based on the legal basis of the current reality and Shaanxi Qinling region, integrated draw on the useful experience at home and abroad, we put forward a sound environmental education system, improve the information disclosure system, the establishment of multiple stakeholder participation system, improve the environmental non-governmental organization security system, to build specific recommendations public participation incentive systems and the like. And trying to build a platform and channel development measures to build Qinling area public participation, the final implementation of public participation in the protection of ecological environment of Qinling.
