Today, with the evolution and development of the knowledge economy and economic globalization, knowledge and patent have become important enterprise assets. But with the "low insertion" global value chain, the OEM must seek the upgrade in the value chain,because the low profits and repeatedly ceaselessly patent litigation。Thus how to solve the patent dilemma to realize the target of upgrade global value chain became an important issue. This paper used by Taiwan's enterprises'experiences and lessons of applying the patent strategy to realize upgrade, to provide enlightenment and reference for mainland enterprises.This paper includes five parts. The first part introduces the background and motivation, selection, and summarizes the current theory research at home and abroad, and finally renders the key research content and research methods. In the second part, it analyzes the main patent strategy of the multinational companies on the basis of literature. Then it emphatically introduces the U.S. patent litigation and of the patent system development in Taiwan.The third part analies the reason of the "international OEM" type enterprise seeking the upgrade in global value chain, and puts forward thress pathes, and factors needing to consider in each path are presented in detail. Also it points out that the enterprises may encounter problems in the upgrade process.The fourth part is the demonstrated analysis, according to the company's annual report foxconn group and the related data analysis of the company in recent years, it analies the application of the patent strategy and according to the relevant data analies the patent strategy influences on the company operations, upgrading of the value chain.Finally, the chapter five puts forward the patent strategy countermeasures and advice for the upgrade of the mainland OEM enterprises on the basis of analysis the Tanwai OEM enterprises.
