A Comparative Study On The Patent Strategy Of China,united States And Japan

Nowadays,competition between countries has become more and more intense,especially in the era of knowledge economy.International competition are focused on the field of high-tech competition,the transnational companies prefer to use patent layout to occupy the peak of technology and innovation.The advanced countries,such as the United States,Japan,have entered the global patent strategy level,whose patent strategy awakening early,and has built a close patent network in the developing countries with their advantages of developed technology.So they can set up patent alliance to achieve industry monopoly position,suppressing the development of emerging industries in developing countries and carved up the market.Now the developed countries have considered the patent strategy as a weapon to take the market and wealth.In this thesis,at first using the literature research method to summarize the development stage and characteristics of the patent strategy of China,the United States and Japan.Then using the statistical analysis method to describe the three countries' status of patent development.The data includes the patent application,the patent license ratio,the PCT application.Because of the early layout of the patent in the United States and Japan,they have gained some advantages of the patent strategy.Using the comparative research method to analyze and the advantage of the US,Japan and the disadvantages of the Chinese patent strategy.Finally,based on the previous comparison,this thesis put forward the proposal to improve the Chinese patent strategy.The results are as follows:the United States and Japan use the global oriented patent strategy,on the one hand they have improved the patent legal system to accelerate the transformation of scientific and technological achievements,on the other hand in the overseas they focus on the patent protection and patent layout.Now China is in the stage of exploration of patent strategy,although the number of applications for patent is the top one in the world,there are still some problems such as lack of cooperation between industry,academia and research,lack of patent intermediary service system and weakoverseas patent layout.Therefore,China's lack of experience in the patent strategy.So we can learn from the United States and Japan to improve China's patent strategy in order to enhance international competitiveness.
