China has developed a new pattern that the public ownership dominant and diverse forms of ownership exist as well after the establishment of socialist market. Diversified forms of ownership led to the diversification of employment patterns, the surging number of employees of non-public economy objectively, who have expanded to become an important part of the labor market. Therefore, with the attention and focus on their social security, especially the pension insurance, it is serious to solve the issue in the economic and strategic way. The harmonious society defined by the Party and guided by Marxism is based on China's national conditions, which also refers to the the harmony of democracy, law, justice, sincerity, amity, vitality, stability, man and nature live in the society. Involving employees of non-public economy into the social security system is a significant move that brings benefits to the nation and the people, the reflection of superiority of the socialist system in the new period.The current situation of pension insurance is quite worrying, for example, employees in non-public economy has low rate of joining pension insurance system; employees insured stop payment of pension insurance due to flow among different regions. There are many causes of these problems. The central and local governments have some policy on pension insurance of employees in non-public economy. However, due to the complexity of this group, the policies expose many problems and flows. To some extent, employees in non-public economy have not really enjoyed pension insurance. The separate legislation for employees'pension insurance in non-public economy should be the proper solution of the current pension insurance problem, which is not only the political and institutional needs, but the human rights and justice demands as well.
