After decades of development, C2C is now an approach of only shopping that is indispensable in people's daily life. Being an innovative trading method, the difference between the business and customer is very vague, while enjoying the easy and efficient way of shopping people are also trying to taste the novel experience of setting up the free online shop. Comparing the ever change reality the law is currently unable to meet practical needs.China's legal system is salient in many issues in relation to the newly developed online shopping method such as C2C, especially lack of appropriate remedy mechanism which protects the online traders'right. However, online traders'right protection is very important to the C2C market, and many countries'electronic transaction law has already set up such protection system through various regulations in relation to e-commerce.This article did a comparative study of several countries'online traders'right protection legal framework and contains three parts. Part 1 focuses on the definition and several variants of online business. Part 2 mainly discusses the necessity of a balanced protection system of online traders'right. Based on the finds from Part 1 and Part 2 the author further sets out his recommendations on building a balanced online traders'right protecting legal framework in Part 3 of this article.
