The Research On The Protection Of Peasants' Rights In The Transference Of Homestead

With the continuous promotion of urbanization, the transference of homestead has become the major trend that cann't be violated. As the leading role in the transference of homestead, homestead is the important material in production and living to peasant. It is very important that how to realize the protection towards peasant's right in the transference of homestead, which is not only related to the key points in the process of integration between city and countryside, but also is the important condition for social stability in countryside. The system of homestead property is the centre of the transference system in homestead, which can be regarded as the transference of homestead property. Homestead properties are composed of the rights of owning, using, gaining, and disposing, which are the main component of peasant's rights. In order to realize the protection of peasant's rights during the process of homestead transference, we must carry on the reform of homestead property system, giving the complete homestead property to peasant, which is the fundamental guarantee in system to the protection of peasant's rights.This paper launchs the research focusing on the system of homestead property. Firstly, through the analysis on homestead property, based on the angle of property economics, analyzing the problems of homestead transference. Secondly, after defining the component of peasant's rights and analyzing the present situation of homestead transference, combining the two factors to do the research on the influence between them. Thirdly, from the view of the protection in peasant's rights, doing the research on the present reform of homestead transference in all kinds of areas, summing up the two kinds of modes which are called the replacement of homestead and the joint business of homestead. Finally, pointing out how to protect peasant's right in the transference of homestead by applying the method of property economics, making clear the direction of the reform of homestead property.
