On The Management Rights And Transfer Of Forestland

With the gradual deepening of the socialist market economy, the trend of forestry into the tide of the socialist market economy is hardly blocked. The transfer of forest land as a basic act of modern forestry, under market economy conditions and China's reform of collective forest right system, the deepening and the continuous development of the rural economy of mountain and forest land transfer has become increasingly popular, and has shown more robust vitality. Reasonable transfer of forest land is the fundamental way to play woodland efficiency and to change the problem of China's poor forest interest. For the problems of the transfer of forest land of our country at the stage,and in the premise of "Forest Law" ,I am expecting to put forward constructive suggestions, which play a positive role in promoting the transfer of forest land.Forest land, in China's current forest management system , the transfer of forest land using rights, not to change the ownership of state-owned forest land and forest land use under the premise of the forest land use rights in accordance with certain procedures, is the way paid by one party to the economic behavior of the other party. Based on existing forest land research, the content proposed forest land, forest clear right to operate the system now features the basic types of forest land and forest land should follow the principle, and puts forward existing problems of Forest circulation. Forest laws and regulations regulate the flow of non-uniform imperfect, and lack of implementation of the Regulations and Rules. The national legislature for the current forest land laws and regulations of the relevant provisions of the forest has been seriously hampered economic development. The formulation of local regulations to some extent is also in the research stage. Then the social security system as foresters has not been established, so lacking of landless peasant's living, forest plantation owners are still the most important means of production and livelihood depend on forest land if not in accordance with legal procedures, foresters contract the right to use forest land will be free to be deprived, loss of life depend. To solve these problems, I put forward countermeasures and made forward-looking recommendations. Finally, after the analysis of constraints in the Forest Land on the basis of the actual situation, I put forward four measures namely the transfer of forestland from the standard way of establishing the basic system, and strengthen government conduct and a reasonable choice of state-owned forest land transfer mode of operation.
