Conventional wisdom holds that the social rate of return to innovation activities significantly exceeds the private rate of return and, therefore, innovation activities should be subsidized or funded by government. Science & Technology Planning Projects is an important tool of funding innovation activities in China. And such funding ways is also crucial to continuous flourish of innovation activities in Hangzhou. But whether such projects can really exert functions largely depends on performance of management system of intellectual property rights obtained from these projects.The paper firstly discuss the rights of government in the innovation fruits obtained from Science & Technology Planning Projects, then concludes five principles for government in management of these intellectual property rights. Then the paper describe and compare management system for intellectual property rights from government funding R&D in U.S and the Chinese corresponding system, which can provides some references for Hangzhou's intellectual property rights management system for Science & Technology Planning Projects. In following positive study, the paper describes the current situation of Hangzhou's Science & Technology Planning Projects, and its intellectual property rights management system, and Based on such analysis, the paper concludes that the system should update in the following issues: protecting consciousness for intellectual property right, setting down of detailed guidelines, incentive direction for intellectual property right in the processes of actualizing of these projects, innovation incentives mechanism, industrialization mechanism for innovation fruit, and classification management. Finally, the paper provides eight suggestions for further construction of Hangzhou's intellectual property rights management system for Science & Technology Planning Projects.
