In recent years, with the intense of market competition, it has been the important means and strategies for most enterprises to gain competition superiority and defeat rival companies by attaining patent technology and holding innovative technologies. But when they have no innovation property right or have no good protection of patent right, with the increasing development of modern technology and investment amount, the imitation will have more and more influence on the income and motivation of innovator.To reduce the influence, using game theory, the paper makes licensing game models and researches the differences of fixed fee licensing, royalty rate licensing and licensing with two-part tariff in a Cournot Duopoly Model by analyzing different licensing motivations of outside innovators and inside innovators, and gives the optimal licensing. Further more, it is analyzed that outside innovators and inside innovators how to use licensing strategies to prevent the imitation. Besides, the paper also builds a model and inducts the patent length to discuss the discount question that is produced because of time factor, and analyze the optimal time to adopt innovative technologies and the function of the delay in technology adoption on the prevent of imitation.
