The Research On Intellectual Property Protection Of Sci-tech Production

At the time of intellectual economy, the development of sci-tech is the key factor to improve the ability of national competition, and the legal system of intellectual property is the assurance of encouraging sci-tech innovation and enhancing national sci-tech level. The developing history of intellectual property system in developed countries has proved it's active effect on the development of sci-tech. The intellectual property protection of sci-tech production in the process of sci-tech innovation in our country, contrast to the active, all-orientational and efficient protection in developed countries, however, is in the passive and inefficient protection status at present. Therefore, combined with the practical situation in our country , analyze the status of intellectual property protection of sci-tech production objectively and exactly ,and table specific proposal, would be quite necessary for strengthening the intellectual property protection of sci-tech production and promoting the economic development in our country. This thesis is divided into five chapters:Chapter 1 summarizes the general issues of sci-tech production, consists of it's conception, character, value and protection, it will lay a knowledge basis for the latter theory and in-depth research in this thesis. According to the author, sci-tech production should be divided into three categories, i.e.Category A: obtained the intellectual property protection already. Category B: can but not obtained yet. Category C: cannot obtained. This thesis mainly researches how to strengthen the protection of Category A by using appropriate methods, and emphasizes on how to obtain the intellectual property production for Category B, for Category C, it will not be discussed.Chapter 2 discusses the correlative content of sci-tech production and intellectual property protection, consists of it's range and condition, necessity and probability , theoretic foundation , practical basic and value analysis. Because not all sci-tech production can obtain the legal protection of intellectual property, we should qualify the protection range. The author researches The latter three parts from philosophical angle and analyzes the theoretic root of them. This chapter provides correlative theoretic knowledge for the latter study in this thesis.Chapter 3 induces the successful experience of developed countries by analyzing the actuality of intellectual property protection of sci-tech production of them.
