An Analysis On Administrative Responsibility In Real Estate Market Regulation Policy

The real estate is a leading and foundational industry in the entire national economic system. Its healthy development may support and lead the development of the entire national economy. Due to the excessively high house price in recent years, the unreasonable structure and the excessively fast investment growing and so on, however, the situation occurs that the middle and low earning people could not afford housing and this harmed the public interest. According to the relevant theories of administrative responsibility, the authority of the government is entrusted by people and the government thus must represent the public interest. Accordingly, the government is responsible for the situation and should take effective methods to interfere the real estate market. Based on such an understanding, this article tried to offer a systematic analysis of the government's administrative responsibility in the current situation of the real estate market, by virtue of a deep level research on both the characteristics of the real estate and the historical context of the development of Xiamen's real estate during 1996-2006.The full text could be divided into three parts. The first part was a description of the current situation and the existing problems of the real estate, both of China and of Xiamen. In the second part, I introduced the relevant theories of public policy and of its function, drawing the connection between the real estate regulation policy and the current market situation from the perspective of Xiamen's real estate market regulation policy goal and of the policy evolution process. In the third part, I elaborated the concept of administrative responsibility, with its public interest connotation as the focus. I proposed that the core of the administrative responsibility is for the public interest and further set the two key points for explaining the concept of public interest, i.e. social welfare maximization and fairness). Finally, I applied the proposition to an analysis of the administrative responsibility of the public policy at Xiamen's real estate market regulation during the recent years, proposing the way of promoting government's responsibility in the real estate market at Xiamen.
