At present, selling land using right by bidding, auction and hanging out one's shingle have played the important role in the land market in our country. The market transaction rule already established generally. Transaction activity is quite active. The range of transaction expands unceasingly. The number of transaction land also is in growth rapidly. However, the development of selling land using right by bidding, auction and hanging out one's shingle is not mature, Some illegal activities and existence question also gradually exposes in actual movement. If these questions do not solve, the land selling behavior will not be standard, the land selling system will not be carried out further, the foundational affects of the market disposition land resource will not be exerted.The article takes government and property development enterprise as main object of study. Because they are the two benefit main body in the land selling, their behaviors can affect mutually. Therefore, when we study the questions'root and how to solve the problems, we need to relate both behaviors.Firstly this article introduces the general situation of selling land using right by bidding, auction and hanging out one's shingle. In the entire sells process, this article pointed out the key work in the land selling, and point out the land appraisal is the most important. Because the price is too high, it will cause the economic loss of real estate enterprise, the price is to low, the real estate enterprise will lose the land. These all do not favor the real estate market healthy development. Therefore, the reasonable and accurate land appraisal is the realistic question which the enterprise must have to face when they compete the using right of land. For the government, the science appraisal of land price is the very important work. In the second chapter, this article introduced the land price's form and trait of the three different ways. Compare and analyse respective characteristic of four kind of different land appraisal method, it can provide for government and the enterprise to choose the appropriate own appraisal method.In the third chapter, this article analyses the gambling process between the central authority and local authority ,the local authority and the real estate enterprise ,between the enterprises. It draw out some questions in the land selling. After this article analyses the malpractice of"price higher is the winner"in the process of selling land using right by bidding and propose the idea that establish the synthesis evaluation according to the science evaluation standard. At the same time, this article establishes the gambling model for the government official corruption and the developer plotting together. This article analyses these models and bring forward the solutions.I hope this article can provide some suggestions for the healthy development of the land market.
