The Study On Effective Protection Level Of Technical Measures To Trade Of China

Along with deepening globalization of economy and liberalization of trade, the technical measures to trade has become one of the most important instruments to gain trade profits for countries with the decreasing of tariff and other traditional non-tariff barriers. In contrast to the important role of technical measures to trade in international trade policy, the theoretical study on the protective effect of technical measures to trade in our country is inadequate. At present, there are many studies on TBT's influence on our country's export and bringing forward some policy suggestions. Facing to the import competition, how to scientifically setup the rational protective level of technical measures to trade of our country under WTO frame, to provide direct and effective protection for domestic market and industry, and to protect human, market, environment and country safety, is still a problem need to be settled. Although this problem isn't arose much attention, or although it has ever been known, this problem relating to trade protection doesn't tally with the mainstream of globalization of economy and liberalization of trade. Thus, quickening the study on this problem seems to be important.Based on the recognition of the above-mentioned problem, I have ever tried to do quantitative analysis. Because of technical measure to trade not easy to be analyzed quantitatively, limitation of researching methods and collecting data as well as lack of quantitative analysis of technical measures to trade at present, I adopt qualitative analysis at last. So this thesis of the study on the effective protection level of technical measures to trade of China is written according to the train of thinking of experience study, case analysis, theoretical analysis and policy research. The first part introduces research background, relative research, study method and study structure; The second part introduces the protective situation of technical trade measures of developed countries, and analyzes the protective effects of EU stipulating technical regulations; The third part begins with the dual nature of technical measures to trade and emphasizes on the differentiate standard of the dual nature as well as the necessary and possibility of imposing technical measures to trade. The fourth part discusses the economic reasons and effect analysis of imposing technical measures to trade. The fifth part discusses inadequate protection and the reasons of technical measures to trade of our country. The sixth part discusses how to impose technical measures to trade to realize the purpose of protection.The ingenuity of this thesis lies on as follows: By way of the study on dual nature of technical measures to trade, the nature of technical measures to trade is defined as economic-based protection and marketfailure-based protection. The definition of the nature is beneficial to establish the theoretical foundation of imposing technical measures to trade to realize the purpose of protection. This thesis puts great emphasis on the economic analysis and protective effect of technical measures to trade. This research strives to analyze the issue systematically and deeply from the new angle. The outcome of the research is significant to our country's import trade and industry protection in theoretical and practical way.
