Effects Of Intellectual Property Protection On China's Import Trade

With the advent of the knowledge economy era,the products and services related to the intellectual property rights in international trade are developing rapidly,the intellectual property rights more and more get the attention of countries all over the world.Since the 1980s,the high-tech products related to intellectual property rights export share of global exports increasing gradually,especially,since the Agreementation Trade-Related Aspects of Intellectual Property Rights established in 1994,purely trade in goods transform to the trinity of goods,services and technology trade direction extension.Intellectual property rights is more and more closely international trade.International trade in view of the intellectual property rights and international trade friction and protection,various countries have carried out a series of measures to protect intellectual property rights.Among them,the system of intellectual property rights of the United States is the one of the most perfect state in the world,the legal system has been basically established a whole set of intellectual property rights,including patent law,trademark law,the copyright laws,anti-unfair competition law.According to the Agreementation Trade-Related Aspects of Intellectual Property Rights of WTO,setting the Uruguay round agreements act.In addition,the United States has a multi-level system of judicial protection of intellectual property rights,to ensure the smooth operation of the intellectual property law.China's foreign trade import and export of high-tech products increased rapidly since joining the WTO,from $ 326.972 billion in 2004 rose to $ 493.59 billion in 2014.But,as Chinese companies in intellectual property application and protection consciousness is weak,and lack the specialized talents in intellectual property protection in China,intellectual property management is not perfect,so Chinese companies constantly in intellectual property disputes in foreign countries,especially in recent years the United States international trade commission(ITC)launched "337 investigation",China became one of the main recipients and largest victim.Only the first half of 2014,six cases of Chinese enterprises involved in,and recently,two Chinese LED companies have also suffered from "337 investigation".Putting forward the major proposition "to strengthen the protection of intellectual property rights" in the Eighteen of the National People's Congress,the third plenary session of the eighteenth further put forward the use and protection of intellectual property rights "strengthening" guidelines,the fourth plenary session of the 18 is further defined in the rule of law in principle for perfecting the innovation system of intellectual property rights protection and promote the transformation of scientific and technological achievements of systems and mechanisms.Therefore,to strengthen the protection of intellectual property rights in the international trade,is the need of our country to participate in the globalization,and constantly improve the system of intellectual property rights protection,promote the economic health of sustainable development.Therefore,this paper studies from China's current foreign trade in intellectual property protection,first of all,cleared up the literature related to intellectual property at home and abroad,introduces the protection of intellectual property rights of four economic theory basis(Comparative advantage theory,the externality theory,product life cycle theory and national competitive advantage theory),and the nature and characteristics of intellectual property rights.Second,adopt the method of qualitative analysis analyzes the present situation and existing problems of intellectual property protection,and combined with the current situation of foreign trade in China demonstrates the protection of intellectual property rights on the impact of import and export trade in our country.Finally,it is concluded that the impact of intellectual property rights on imported conclusion and the corresponding solutions.The article mainly includes the following five parts:The first part is mainly about the article selected topic background and significance,research status at home and abroad,the main contents of the paper and the research methods,as well as the paper expounds the innovations and shortcomings.The second part elaborated the intellectual property rights protection theory(comparative advantage theory,the externality theory,product life cycle theory and national competitive advantage theory)and the related concepts of the protection of intellectual property rights.The third part introduces the protection of intellectual property rights of China's foreign trade development status and its relationship with import trade development;The fourth part combined with the gravity model,the current situation of foreign trade in China,analyzes the protection of intellectual property rights for influence in the development of Chinese import trade;The fifth part for problem of intellectual property rights protection in our country put forward the corresponding countermeasure and the conclusion.
