The Employee voice is realized through the labor union that could collect and express the will of employee. The democratic participation is carried out by the labor union, employee congress and collectivity contract system. These are necessary in the transformation period of SOE. The democratic right of labor union is carried out by the employee congress, and the delegacy of labor union is centrally embodied in the collectivity negotiation and the collectivity contracts. As far as the actual situation is concerned, the academic researches were focused on the multi-angle description and analysis of the basic issues, such as definition, character, and function of labor union, employee congress and collectivity negotiation. Moreover, combining with cases analysis, they expatiated and summarized the measures and approaches of the realization of the voice of employee. The main achievements were attributed to the western academicians. Although domestic scholars also discussed and researched on union labor theory, they did not deeply combined with the companies'actual situation of China's transformation period. So, the paper tried to integrate the actual situation of those companies to do research on the voice of employee.In the first place, the paper reviewed the theoretic content that could influence the actual voice of employee, covering the labor union, employee congress and collectivity negotiation.First, the paper brings forward several understandings of labor union:1.the labor union has the function of collectivity negotiation and voice.2.the labor union can influence and coordinate labor relationship, helping increase the salary level.3.the labor union has the function of authority perseveration, the degree is influenced by the scholars'research.Second, the understandings of employee congress are listed below:1.the employee congress is the system that guarantee and realize the employee's democracy right. It is the institution for employees to participate in the democratic management and exert the democratic management right.2.where there is employee congress, there is comparatively higher evaluation of labor union.3.the labor union is the work institution of employees, responsible for the routine of employee congress.Third, the understandings of collectivity negotiation:1.the collectivity negotiation has the economic function, existing as the main activity of labor union.2.in order to obtain favorable effect, collectivity negotiation should have rigorous organization and trust between each other, considering other's interest and actual capacity.3.the delegacy of labor union centrally embodied on constructing collectivity negotiation and signing labor contract.Introduction and review on labor union, employee congress and collectivity negotiation。The paper includes: the English scholar Webb's view point is that the purpose of labor union is to enhance the power of employees when there is a negotiation; Freeman and Medoff took American labor union as research object, considering labor union has the voice function; Zhu Xiaoyang's Temporarily Statute of Chinese Employee congress was to realize workers'democratic right and self management and to enhance workers'power. Allen's"collectivity negotiation not only has economic function but also has the effect of government control. Synthesizing these comment, the paper render that labor union should represent and stick up employees'interest and employee congress should be responsible for the advancement of democracy, realization and guarantee of employees'democracy right. And we should coordinate labor relationship and realize voice of employee through collectivity negotiation.In the next place, combing with the actual situation and all the characteristic of enterprises'development in the transformation period of SOE, the paper process a pertinence research on"issues of SOE's labor union in transformation period". The research mainly involved in four aspects:1.The employees need the voice mechanism in transformation period of SOE. The paper conducted research on four layers of the rapid declination of identity, status and right of employee, the breakage of mentality contract between employees and enterprises, the threats to employees'benefit from powerful management authority and the right of woman employees got more damage. It pointed that, in the transformation period of SOE, the of labor union lack the adaptability to the disciplinary of work development and it is insufficient in the research of practical and theoretic issues.2.There exist problems in the labor union voice mechanism in the transformation period of SOE. The paper based on the transformation period of SOE, analyzed the status of labor union voice, the representation of whose benefit and the effectiveness of labor union voice. And it deemed that the labor union of SOE should be an organization that be independent, represent works'benefit and maintain works'right effectively. But due to the actual situation of transformation period, it confused again.3.There exist problems in employee congress voice mechanism in transformation period of SOE. The paper expatiated the problem that the inharmonic between employee congress and enterprises'operation mechanism, the informal of relative law of employee congress voice and the employee congress voice system did put into effect. Also the paper analyzed the insufficient guarantee and fulfilled situation of labors'working rights and interests and democracy right.4.There exist problems in collectivity negotiation mechanism in SOE during the transformation period. It is hard to realize workers'interest from collectivity contract system. The paper analyzed the lack of agreement on the function of voice of collectivity negotiation among labor union, governor and employee in SOE during the transformation period. Then, it found the matters.In the Third place, based on the power maintenance problem in the transformation period of SOE, the paper rendered the realization manner of employee collectivity voice. We should construct the maintenance right mechanism and enhance the construction of democracy by maintaining collectivity interest and increasing the labor union construction power. In the transformation stage of SOE, we should sufficiently enhance the function of democratic management of employees especially the function of employee congress. Innovating the efficient approach of democratic management, by negotiation among three sides and collectivity negotiation, under the powerful organization function, the employees'interest request will get centrally reflect, and be expressed by well-regulated procedure, which should promote the harmony and stabilization of labor relationship. We should also enhance the organization construction of women employees, and maintain their legal right and interest and protect their special right.In the fourth place, the paper took an example of SOE S in J province. It according to standards: 1, the SOE in transformation period hold the balance in its industry. 2, the company is the scale-economy type. 3, it can develop labor union task and democratic management task using its owe labor union organization. Moreover, the paper conducted empirical research and analysis on the three aspects.In the end, synthesizing the researches, the paper deemed that in the transformation period of SOE, the labor union, as free-will conjoined crowd organization of working-class, is the collectivity voice and it plays the core role in the employees'participation of democratic management. We should make use of employee congress, maintain the democratic voice of employees and promote the construction of democracy management mechanism. Also we should do more theoretic researches and practical exploration on democratic participate, equality negotiation, collectivity contract and three-side coordination mechanism. And construct new type work relationship that fits to the SOE in transformation period. In one word, the collectivity voice of employee is realized through the mutually sustention and reciprocity among labor union, employee congress and collectivity contract system.
