The current land requisition system formed in the planned economy era provided the strong policy support for the industry development in those days. However, along with the quickened pace of the industrialization and urbanization and the increasing rhythm of non-agricultural of farmland, the drawbacks of this system have emerged increasingly day by day. On the one hand, the only legal approach to transact the collective-owned land on the market within the restraints of the current system is to use the government's right of land requisition to change it into state-owned land; On the other hand, the current system itself has many disadvantages. The vague define about the"Public interests"and the low cost of land requisition lead to and also promote the local government's illegal behaviors in land transaction; the low compensation of land requisition and the considerably imperfect allocation policy bring a lot of farmers involved in land requisition into the condition of"no land to cultivate, no job, no minimum living standard security."So compensation and allocation in land requisition have become hot and difficult issues in the land management in recent years. China's practice of reform and opening-up proves that industrialization and urbanization are basic ways of resolving the "three-agriculture" problems, so the study on the problems raised in land requisition has great theoretical and realistic significance for the acceleration of industrialization and urbanization in China, development of new socialist countryside and the construction of socialist harmonious society.This dissertation is divided into six chapters including the forward:Chapter 1 is an introduction. In this part, it elaborates the purpose and significance of the study combined with problems raised in applying the land requisition system in reality, and gives a brief introduction and evaluation of the research tendency on land requisition at home and abroad. At the same time, the conception of the thesis is put forward.Chapter 2 to Chapter 3 is an outline of the compensation system in land requisition in China, and a comparison with that in other countries and regions. In this part, the writer has briefly discussed the relevant concepts and theories of the compensation system in land requisition and reviewed the development of land requisition system since the country's foundation. At the same time, compared with the compensation system in land requisition in other countries and regions, the writer proposes the primarily problems and analyzes the ideas that we can borrow from other countries and regions on this issue.Chapter 4 is the analysis of the basic method of calculating the compensation in land requisition and its improvement. On the basis of the detailed analysis of the current method of calculating the compensation in land requisition, the writer points out that the social security value should be taken into consideration when doing calculation, the method should be proved and improved by the factual cases and the calculating results should be analyzed.Chapter 5 is the analysis of the allocation mode of how to settle the farmers involved in land requisition at the present and its creation. In this chapter, focusing on the current allocation mode formed in the practice of land requisition, the writer mainly analyses its advantages and disadvantages and its applied scope. At the same time, the writer draws a conclusion on the practice and exploration of settling the farmers involved in land requisition in some regions in China. On the basis of this, the writer puts forward the reasonable mode and the policy support it needs.Chapter 6 is about countermeasures for the improvement on compensation and allocation in the land requisition system. Aimed at the problems in this system, some suggestions about how to perfect it are given in order to be of assistance in some degree.Ultimately, based on the review and summary to the whole paper, the main conclusion, deficiencies and research prospects are put forward.
