The Defect Analysis And Strategies On The Chinese Current Land Requisition System

Quick industrialization and urbanization have been the catalyst for acceleratingdevelopment in China. In the meanwhile, they have brought a series of socialproblems. One of the most important issues is the land compensation and laborreallocation for farmers, caused by public land requisition for new projectdevelopment. This has led many farmers to appeal to the higher authorities for helpsomewhere. From some perspective, it forms a factor of social instability, making itas the 2nd focus among 'farming, farmer, and county' problems in China, which isonly next to tax reformation.Although land requisition's compensation for farmer has be settled in the 47thClause in 'the Law of China National Land Management' explicitly, its compensationstandard has distinct character of planned economy, which means it is inappropriatein the trend of reformation toward market economy. In the thesis, we analyzedrawbacks of current land requisition framework in terms of collective landownership, land requisition scale, farmer's welfare lost, and land requisition process.Then we propose a so called 'asset and assurance' compensation scheme. It concludesthat compensation approach is critical to farmer reallocation. We also givesuggestions on system establishment and compensation calculation method. Anyway,the author also understands that land requisition is a very complex issue associatedwith policy, technical, and operations issues. It can only be refined in the realimplementation.
