| Competition law is the law that adjust the market competition relationship and market competition administration relationship in the economic operation. Based on the analysis of economic and legal features of the telecommunications and EU competition law ,I would like to discuss the specific application of competition law in the field of telecommunication regulatory, in particular the area of define and regulation the behavior which called abuse of dominant position. Finally I try to provide some useful advices in China's telecommunications regulation .I will analyze from following three aspects:one,general analysis on economic and legal features of the telecommunications. In the first part ,I will analyze the basic concepts of the telecommunications industry,the relationship between the natural monopoly and telecommunications industry and the features included the scale in economies, network connections, strict control by government . Then, by comparing the Chinese and the EU competition law ,I analyze that how to recognize the dominance position in telecommunications enterprises .The analysis can be grounded upon defining the abuse behavior of dominant position .Second, EU competition rules in regulating the abuse of dominant position on the telecommunications industry. This chapter introduces the EU competition legislation in the field of telecommunications industry ,which is the legal basis of defining the abuse behavior of dominant position. Then I analyze the abuse behavior in EU telecommunications industries, such as predatory pricing, refusal to deal, tied up and bundled, excessive pricing. Third, China's condition of competition in telecommunications industry and proposal in the legislation . Firstly, I analyze the current regulations and the condition of competition in the telecommunications industry. Then, by comparing with the abuse behavior existed in EU,I provide some useful lessons in China's telecommunications legislation and regulatory. |
