Research On Land Leasehold For Land Asset Disposal In State-owned Enterprises

Our country is one socialist public ownership country, land ownership belongs to the country. Objectively, land ownership must be embodied economically. At the same time, the abuses, which have been produced by the traditional methods of using land, are more and more obvious along with the transition from the planned economy to the market economy. For example, the waste phenomenon for land resource is serious, the state-owned land asset runs off in large quantity, the competition is unequal between enterprises. So the reform for land-use system must be carried through. Correspondingly, land asset needs to be disposed reasonably in the reform for state-owned enterprises.In spite of recombining limited liability companies, stock limited companies, or mergers, leasing, insolvency, all involves the land asset disposal during the reform for state-owned enterprises. Whether land asset is disposed scientifically or not, which not only relates to the maintenance, increment, movement healthily and regularly for land asset, but also relates to whether enterprises can establish the modern enterprise system, which is clear property rights, clear responsibilities, separate governments and enterprises, scientific management. Thus the whole economic system will be influenced significantly.In this situation, it is extremely urgent to explore the methods for disposing land asset conforming to the reality in the reform for state-owned enterprises. For this purpose, many cities begin to launch a pilot project on leasehold method for disposing land in state-owned enterprises, and have got the initial effect. However, as lacking clear theoretical direction and standard working pattern, as well as essential basis of policies and laws, there produces many problems and deviations in leasehold method for disposing land. So it is necessary to think calmly on leasehold method in the reform for state-owned enterprises and its practice, which is not only beneficial to analyze the sources of problems and correct the deviations brought about by land leasehold operating, but also beneficial to establish the leasehold method with land asset characteristics in state-owned enterprises.This paper, firstly, analyzes the existent problems brought about by leasehold method for disposing land asset in state-owned enterprises. Especially, the existent problems of disposing method choice, rent, leasehold deadline and leasehold land management are analyzed. This paper begins on the boundary of land leasehold for land asset disposal in state-owned enterprises. At the same time, the origin and development of land leasehold in land asset disposal for state-owned enterprises are expatiated. Disposing method choice, rent, leasehold deadline and leasehold land management are analyzed theoretically.This paper aims at the problems of disposing method choice, rent, leasehold deadline and leasehold land management, and the corresponding solutions are pointed out. In order to solve effectively these problems brought about by leasehold method for disposing land asset in state-owned enterprises.In the end, on the basic of analysis hereinbefore, summarizing this paper is given, and the problems which need to be studied more are pointed out.
