Study To The Protection Of State-owned Assets In The Process Of State-owned Enterprise Reform

The loss of state assets in the process of state-owned enterprise reform has become a social hot issue in recent years. From 2001, MBO was introduced to our country extensively. Some listed companies started the actual operation in the MBO way. From regulating to restricting, the policy of China to this reform mode has experienced different stages. The actor tries to analysis the reason of the loss of state assets in the process of MBO and gives the solution by this paper. In the process of State-owned enterprise reform, MBO model ----the way of state-owned property rights was transferred to the enterprise management made some our standing issues. Legal theory and judicial practice should be a benign interaction and explore any legal channels of protecting the state-owned assets. From management buyouts (MBO) point of view, this paper will discuss the problems under the state-owned enterprise reform in order to protect the state-owned assets well. It will study the protection of the state-owned assets. This paper is divided into three parts--introduction body and closing remarks.And the main body is divided into four parts.The first part will elaborate the present situation of the loss of state assets and the necessity of protecting the state-owned assets in the process of State-owned enterprise reform .The second part and the third part focuse on the evaluation of the MBO model, and introduces the advantage and is advantage of MBO model, and the reason of the MBO model.The forth part will mainly elaborate the thinking to the MBO model.
