| Since Silicon Valley hi-tech park came into being in 1950s beside Stanford University, in several tens years short time, hi-tech parks, which are all over the world, have got the gigantic success and already become main strength for technology innovation in every country. The nature of hi-tech park is comprehensive base , which is on the basis of fund input, takes concentration of brain power as backing , and sets high and new technology innovation and changing it into productivity as a target, boosts the Administration, enterprises, schools, institutes , finance tied in wedlock mutually and drives the coordinated development of technology innovation, economy and society.The success of hi-tech park owes to many requirements, law support is one important condition among them. Our country also provides multi-layered law protection for the construction and development of hi-tech park., but it also exists a few defects. For example, united special legislation for hi-tech park is not issued, and related regulations spread in relevant legislation and rules which give priority to local regulation that behaves mixed and disorderly, and works for itself.The paper, at first, has analyzed the concept, the characteristic of hi-tech parks, and the connotation, the legislation pattern, the content and the characteristic of legal protection for hi-tech park, proposing that this paper only studies in lawmaking aspect and dividing the content into two parts, that is specialized laws and common laws.And then studies the current situation, legislation pattern according to the first part, legislation content from specialized laws and common laws and raises the existing problems of legal protection for hi-tech park in China from specialized laws, scientific and technological law, intellectual property law, tax law, Financial Law etc.Meanwhile the paper, comparing with current situation of legal protection for hi-tech park in developed countries, such as America, Japan, Taiwan district, learning their successful experience and theory achievement, contributes to raising a little constructive suggestions to perfect the legal protection for hi-tech park for China. At last, the paper emphasizes in how to perfect legal protection for hi-tech park of China, and brings forward the fundamental principles and Countermeasures from specialized laws, scientific and technological law, intellectual property law, tax law, Financial Law etc, and adjusts and chooses the law and policy system which is beneficial to develop hi-tech park of China, and creates a rational business environment, and realizes law innovation in practice. In all, the paper contributes to providing more perfect legal protection to guarantee the development of hi-tech park of China. |
