A Research On Chinese Export-oriented Enterprise's Patent Strategy

Developed countries enterprises use patent strategy actively. They cover China and other countries which are related to their rights and interests with patent to seize the market and get enormous economic benefits. Export-oriented enterprises are the vanguard of the tentacles of China's economy in the world economy. Moreover, they are China's main participants in international competition, but a considerable part of the export-oriented enterprise ignored the protection and use of intellectual property, in particular, are not good at strategic use of patents. So the enterprise encounter in losses when they are confronted with patent war with foreign enterprises. In order to adapt to the intense competitive environment at home and abroad, China's export-oriented enterprises are in urgent need to actively formulate and implement effective patent strategy.In this paper, the author puts forward a set of patent strategy operating theory adapt to Chinese export-oriented company through the analysis of export-oriented company's actuality and characteristics Combined with analyzing detailed case by adopting the methods of literature survey, statistical analysis, data analysis, comparative analysis, summarized, interpreted and so on. Implement patent strategy through the status and characteristics analysis of Chinese export-oriented company, combined with specific case studies to take successful experience of patent strategy adopted by developed countries' Companies for reference. This thesis uses the relative theory of management, economics and law and comprehensively as well.This thesis is divided into seven chapters. The first chapter expresses the significance, study status and innovation of this paper.Chapter 2 analyzes the type, definition, characteristics and the important role of export-oriented enterprises in the national economy to explain the significance of implementing patent strategy by Chinese export-oriented enterprise.Chapter 3 starts with the basic issues of the enterprise's patent strategy to overview definition, characteristics, composition and type of the enterprise's patent strategy.Chapter 4 introduccs the content and analyzcs the features of the United States, Japan, South Korea, and other countries' enterprise's patent strategy to get enlightenment on the basis of analyzing successful experience of patent strategy implementation by developed countries' enterprises.Chapter 5 is on the basis of Chapter 4 to clear the implementing objectives and principles of Chinese enterprise's patent strategy, and try to form a theory applicable to Chinese export-oriented enterprise's patent strategy operation by using international generic methods.Chapter 6 expounds specific measures and effective implementation of patent strategy of China's different types of export-oriented enterprise according to their actual situation on the basis of chapter 5.Chapter 7 analyzes two specific patent cases of China's export-oriented enterprises. Then sums up the successful experiences and learn the lessons from failure to provide guidance for the patent work in the future.Finally, the author makes the conclusion for whole thesis and puts forward the issue which needs further study.This thesis studies export-oriented enterprise's patent strategy according to its characteristic and demand and attempt to divide export-oriented enterprise into three types and proposes suitable patent strategy pattern and the concrete implementation measure for different type. This paper's discussion is helpful in instructs our country's export-oriented enterprise's patent strategy practice to enhance its competitive power in the international market.
