Farmland development right is one of the most important land rights of Anglo—American law. It is right of changing property of land use. Its primary purpose of setting up land development right is to protect farming land ,protect natural resourse and entirement. In recent years ,the peasants'legitimate rights and interests are often damaged specifically for our country purchasing land ownership on a requisition basis being often abused, and the large amount of cultivated land quilt turning into construction illegally , China economics circles have developed fruitful research on farmland development right ,law circles paid little attention to it and there is nothing about it in china law . But problems on farmland development right have appeared for a long time with the development of rural economics.This text sets out from the existing domestic and international research result concerning farmland development right ,first to farmland development right of the basic theories sisterly and elaborately. Immediately analyses the necessity and important . From the angle of the theories,system analyzed the obstacle of our country constitution farmland development right immediately after , and in the brief introduction foreign farmland development right ownership the foundation of the system up ,several suggestion has been put forward for the contitution of farmland development right in our country. finally clarified meaning of income of land development right, at same time ,it analyzed existing distributing mode of income of land development in our country and pointed out that central government is a main gainer.
