Investigation On Reform Of Property Rights Institution In Chinese University-owed Technical Companies

Technical companies which are set up by universities or colleges play an essential role in facilitating the transformation of scientific research into productivity and in making up funding shortage of these higher education institutes. However; with the development of such technical companies in universities, problems such as obscurity of property, inefficiency of management institution, lagging of management skills, lacking of institution of supervision have been appearing gradually. There problems have already affected further economic expansion of such technical companies and has brought economical and Legal risks to companies and related universities and colleges. The clarification of property rights is the primary premise for companies' transformation of institution. This dissertation conducts systematic research on technical enterprises in universities and colleges from the perspective of economic theories such as enterprise property theory and institution changes theory. And this thesis explores the enterprise joint property institution based on capital institution and human capital property according to technical enterprises in higher education institution. The main idea of this dissertation is summarized as follows:The evolution and development of technical companies owned by high education institutes. In the 2nd and 3rd parts of this dissertation, the author has a review about related theories. The writer describes the development path of these technical companies and search for historical course of the formation of property rights. The research indicates that the development and evolution of property rights is the result of market economy evolution.The limitation of property rights of technical companies owned by universities and colleges. The dissertation has analyzed and summarized the distinctive characters and imperfectness including ultimate property obscurity, singularity of enterprise property structure, lacking of consciousness of human capital property, serious loss of intellectual property, ill-standardization of incentive mechanism of property. The research result indicates that the splitting and ownership is a long and difficult process of game.The case analysis of the reform of the enterprise property institution in technical companies owned by universities and colleges. On the fifth part, through the analysis of two cases, the dissertation investigates effective path of enterprise property theory. The study reveals that the building of so-called firewall between universities and companies set up by these higher education institutes, the asset management limited liability companies which are wholly state-owned. The companies are responsible for the transformation of wholly university-owned technical companies. It indicates this is the perfect combination of induced changes and mandatory changes.Thoughts on the innovation of the enterprise property institution in technical companies owned by universities and colleges. On the sixth part, through the above-mentioned analysis, the author proposes the innovative countermeasures according to limitation of property rights in technical companies. the writer proposes the idea that the reform path of such institution is the enterprise joint property institution. That is the pan-shareholding system. It is the employment of capital, labor, entrepreneurship skills, scientific and technological inventions into share-holding process, diversification of property rights in technical companies, and restructures the new relationship between such technical companies and universities or colleges.
