On The Right To Development And Implementation

The essay, first of all,expounds the origin of the right to development from the time background of setting forth the right to development and the process of its establishment. As an independent human rights form, the right to development is the product of struggle and compromise of both old and new international political and economic order, the right to development is a specific kind of historical and cultural phenomenon. It has experienced a successional variation process from right idea breeding to the right localization of target, arrives at the right to development legal again. According to "Declaration on the Right to Development",the article stated the basic meaning of the right to development, and carried out a detailed analysis about the main body,about the object and the content of the right to development,then proposed the right to development is fundamental human rights, the right to development has the pivotal value function for the universal realization of human rights.The right to development is a basic rights for individuals, peoples and countries actively,freely and meaningfully to participate in political, the economical,social and the cultural development and fairly enjoy the benefit which the development brings. It is not only an individual human rights, is also a country or nation's collective human rights. As an individual human rights, its main demands at the national, mainly aims at the entire international society as the collective human rights. Therefore, all countries have the obligations and responsibilities to achieve the right to development. Since the development between country and national in the international society , between the area and the area in a country is not very balanced,it will be the common long-range mission for the international society to carry out the right to development to realize. In this paper, theoretically proposed the realization conditions , analysised the barriers, explored the ways to realize the right to development. Then this article toke the European Union system's in right to development as the model, elaborated in detail its social policy which promotes the individual right to development realize,its region policy to impel the region right to development ,and its the Pratt and Whitney policy to promote the global cooperation. Finaly,combiningChina's actual situation, I derived the European Union system's essence of the right to development, and puted forward the proposals on how also to be good quickly advance the China right to development to realiaze.
