On The Perfection Of The Housing Security Legal System In China

Whether the basic housing demand can be met is vital to the construction of the harmonious society.According to the experience of developed countries and regions,the marketization of housing is the main trend.However,the establishment and improvement of housing security system is still the basic task of governments.The report of the seventeenth plenary of the Chinese Communist Party requires "speeding up the solution of urban low-income family housing difficulties".The goal of "people owning their own house" is far from achievement.Housing security is still under a long way to go.This paper closely contacts to China's housing security trends,and expatiates on viewpoints combined with the developments of housing security legal system.The first part of this article is about the general principle of housing security legal system,the analysis of correlation concepts on the premise of my own understanding.Such as the broad and narrow sense of the conception of housing,the natural attributes of housing,the social attributes of housing and so on.I try to connect my own views with the basic theory.And I insist that the social attributes is the essence attributes of housing.This is the foundation to discuss that "the Government must play the primary responsibility to the housing security".At the same time, the article raised the other social attributes of the housing - collaboration, which is the theory opposing the view that the housing security is unfair.In addition,the legal relationship of housing security analyzed from my own understanding.The second part of this article is mainly about some situation of China's housing security legal system,the insufficiency of China's housing security legal system.Among them,different from the negative attitude of some articles,this article analyzes the detailed gains and losses of China's traditional planned economic system.The third part of this article introduces the situation of the housing security system in a number of well-developed market economy countries (or regions),and summarizes some experience that we can refer to.The fourth part of this article puts forward a number of independent thinking about how to improve China's housing security system.First,I propose to amend the Constitution of the provision and make it a constitution basis of housing security legal system.In addition,as the public ownership of land is the critical issue to the housing security system, I set up a special section to discuss how to establish the foundation of the housing security system.Then,this article puts forward a number of improvement measures for the housing security system according to the concrete conditions of our country.Finally,some discussion is made about the development of China's housing security system.The final part of the paper points out,despite the change of social circumstances,it is our unalterable mission to develop housing security. Furthermore,a bright future is predicted to be achieved in housing security.
