Government regulation which also has the meaning of the rule,the law and the order means that the government systematically manage and control. In order to maintain the order of the corresponding fields.The government manages social life and economic development through making laws and regulations or promulgating a decree. Compared with enaction,government regulation is more flexible,fastand so on. Our country's online games is in the ascendant at the rapid development stage, every year the growth rate of the number of users market scale or the profits of manufacturers is near 60 percent. At the same time, the development of online games has also led to a series of social problems which allows users to indulge in the game and entice a minor crime. So the legislative management of online games is necessary whether from the perspective of protecting the healthy and orderly development of online games market or the perspective of protect social public life. However, our country has no corresponding laws on the online game now. Therefore, the management and the control in the form of Government regulation in this field will be more realistic. Reasonableness, necessity, its depth and breadth of the government regulation in the online game field are the problem that we need to focus on The first part of the thesis introduces t the concept of the online games and government regulation with emphasis on understanding the concept of government regulation. The concept of government regulation which was initially used in the economic field was slowly focused on by the way of law and sociology. It was initially limited to the micro-economic field, this opinion is clearly outdated.According to the summary of the related theory of government regulation, government regulation should include indirect control and direct control. Direct control includes economic control and social control. Government control whether in the economic field or in the field of social life has its evidences. At the same time the government regulation also includes the establishment and the maintenance for a variety of order. Secondly, the introduction of characteristics of government regulation, the history of its theory and the implementary principles further deepen the understanding of the theory of government regulation in this part. Finally, the necessity and the evidence of the intervention of the government regulation in the area of online games is also discussed. Firstly, from the economic point government regulation is aimed at suppression of "market failure". Too much free market will inevitably not be able to maintain itself healthy and orderly because of their own blindness and other characteristics. Secondly, social control is necessary because of a series of social problems caused by online games. Thirdly, the establishment and maintenance of order shows that the government regulation has characteristics of indirect control.The second part of the thesis which is divided into three parts analyzes the shortcomings of online games.The first part introduces operational mode and characteristics of game rating agencies in the United States, Japan, Europe as well as chinese existing games rating system. Compared with the foreign game rating system, this part points out that the progress and merits of chinese games rating system is the establishment of dynamic rating mechanism for online games.the deficiency is not only that rating agencies are not subject to any functions at supervision of the online game developers and operators, but also exists in the selection of appraisers, assessment processes and the division of age level. The deficiency eventually makes the system exists in name only.The second part introduces chinese existing publishing and distribution system of online games. The Ministry of Culture struggles with the General Administration of Press and Publication for the power of examination and approval on online games, because of the absence of relevant laws and administrative regulations. A lot of problems such as multiple management and duplicate seting of administrative license appear. The third part introduces the management after the operation of online games. In this stage chinese regulatory tool is "Online Game Fatigue System" which is used to prevent minors playing games too long to protect the minor's physical and mental health. However, because of the sufficient proof of this system and underestimation of many possible problems, the system not only fails to prevent minors being too much in the game, but also leads a series of illegal incidents.The third part concludes characteristics and requirements of the government regulation by the way of combining the findings of the first two parts. Finally there are some related suggestions on the government regulation system.Government regulation system of online game should be perfected from three aspects:Firstly, the appropriate industry associations should be set up .Some problems which could be solved by the industry or the market should not belong to the area of governmental authority. The industry association should exert the autonomy of the industry in order to play the role of intermediary between the government and the market. Online Game Industry Association should draw lessons from the pattern of the bar association and the securities industry association. In order to maintain healthy functioning of industry associations and the market order, companies engaged in online game development and operation should be included in the scope of supervision of the association.Secondly, perfect grading system for online games should be set up. In addition to the human selection mode of the appraisers and the scientific hierarchical division, the most important thing is that rating results should be reflected in the in the reality of the operation of online games through the effective way to make Age-specific users access to the appropriate game products.Thirdly, the supervision of the operation of online games should be perfected through the technological means.
