Due to the growing trend of the relatively new way of doing business through electronic commerce in China, the unique characteristics of e-commerce that takes places on the internet have been observed. These include features like absence of physical boundaries, marketing of digital products and a world-wide potential market for anyone who has internet access. This thesis analyzes how businesses and customers could protect and exercises their business ideas on e-commerce by applying intellectual and industrial property rights.Ignoring any traditional subject of intellectual property rights that take place on regular commerce, this paper will only focus on special issues that can only be found in e-commerce in which the international community is not yet ready to agree on a common perspective, on issues such as software protection, downloading of digital products, domain name protection and e-business models protection.This research will show the current situation in China, about how it protects intellectual property rights on e-commerce, as well as how it differentiates from others countries. This is done through analysis on how China, as a member of the major intellectual property treaties, has adjusted its domestic legislation to deal with software protection and downloading of digital products under the P.R.C. Copyright Law, how it deals with Domain name under P.R.C. Trademark Law and P.R.C. Unfair Competition Law, and where China stands, on which subjects could be considered for protection under P.R.C. Patent Law.
