Research On The United States Imposing The Anti-dumping And Countervailing Measures Simultaneously Towards China Products

The United States has initiated anti-dumping duty and countervailing duty investigations on imports of Coated Free Sheet Paper from the People's Republic of China in 2006,which could be treated as "benchmarking" of USA against China's trade remedy policy.Although there was legal basis in international and domestic law,USA imposing both anti-dumping and countervailing duties on imports from the People's Republic of China was suspected of abusing the corresponding rules in the practice.The USA imposed both anti-dumping and countervailing measures on imports from the People's Republic of China,which has become one existing threat for our government and enterprises. Therefore,it is urgent for our government and scholars to study the anti-dumping and countervailing rules of the WTO and American domestic law,as well as how to deal with the measures of USA.Based on the Study of WTO rules and American law,this paper analyze America's main law clauses and technical matters by integrating the case of Coated Free Sheet Paper from the People's Republic of China,and then bring forward countermeasure.Divided by three parts,the first part of this paper will investigate the legal feasibility of anti-dumping and countervailing measures simultaneously applied in non-market-economy country in the multilateral perspective.The second part will overview America's investigation procedures of anti-dumping and countervailing measures,and special rules in non-market-economy country.Concrete analysis also will be carried out under the case of Coated Free Sheet Paper.At the last part,in connection with the trend of America against China by imposing anti-dumping and countervailing actions simultaneously, countermeasures will be put forward,including our government,enterprises and the trade association.
